Terms of Service

1. Parties

These Terms of Service ("Agreement") are entered into between DNS Group Yatırım ve İnovasyon Anonim Şirketi ("ComplyMate", "Company", "we") and the user accessing ComplyMate services ("User", "you").

2. Service Description

ComplyMate is a SaaS platform that automates EU AI Act compliance. The service includes:

  • AI system inventory management
  • Automatic risk classification under the EU AI Act
  • Generation of FRIA (Fundamental Rights Impact Assessment) reports
  • Regulation change tracking

3. Pricing

ComplyMate is currently in PILOT PERIOD and is offered free of charge.

A transition to paid plans will occur after the pilot period. Pricing changes will be communicated via email at least 30 days in advance. Users have the right to close their account within this period.

4. User Obligations

The User is obligated to:

  • Provide accurate and up-to-date information,
  • Maintain account security (not share login credentials),
  • Use the service for lawful purposes only,
  • Not infringe upon the rights of third parties,
  • Not upload malicious software to the system,
  • Not exploit the system through automated scraping or similar methods.

5. Intellectual Property

The ComplyMate platform, software, design, content, and brand belong to DNS Group. The User may use the service only for personal or corporate purposes. Reverse engineering, copying, and distribution are prohibited.

Data uploaded by the User to the platform (AI system inventory, descriptions) belongs to the User. ComplyMate processes this data solely for service delivery.

6. Service Interruption and Warranty

ComplyMate does not guarantee uninterrupted service. Interruptions may occur due to scheduled maintenance, technical failures, or third-party provider (Supabase, Vercel, Anthropic) issues.

The service is provided "as is". AI classifications and FRIA reports provided by ComplyMate ARE FOR INFORMATIONAL PURPOSES ONLY and do not constitute legal advice. Ultimate responsibility for EU AI Act compliance lies with the User.

7. Limitation of Liability

To the maximum extent permitted by law, ComplyMate's total liability is limited to the amount paid by the User in the last 12 months (during the pilot period, as the service is free, total liability may be 0).

ComplyMate is not liable for indirect damages, loss of profit, or loss of data.

8. Termination

8.1 By the User

The User may close their account at any time. Data is subject to the retention periods specified in the Privacy Policy under applicable data protection law.

8.2 By ComplyMate

ComplyMate reserves the right to terminate the User's account in the following cases:

  • Material breach of the Agreement
  • Conduct harmful to the service
  • Unlawful use

Termination will be notified via email 30 days in advance, except in urgent cases.

9. Amendments

ComplyMate may update these Terms of Service at any time. Material changes will be communicated via email at least 30 days in advance. The User's continued use of the service after notification constitutes acceptance of the new terms.

10. Personal Data

The processing of personal data is described in detail in the Privacy Policy. By creating an account, the User is deemed to have accepted the Privacy Policy.

11. Governing Law and Jurisdiction

This Agreement is governed by the laws of the Republic of Turkey. ISTANBUL COURTS AND ENFORCEMENT OFFICES have exclusive jurisdiction over any disputes arising from this Agreement.
